The 24-year-old — his mop of hair dyed red — appeared sedated as he faced charges of slaughtering 12 Batman film fans. Holmes, a drop-out PhD student, may face execution by lethal injection if convicted.
After a 12-minute hearing in Centennial, Colorado, District Attorney Carol Chambers said prosecutors would make a decision on whether to seek the death penalty after consulting with his victims’ relatives.
She added: “That’s a process that impacts on their lives for years.
“We would want to get their input before making a decision on that.”
Pale Holmes stayed silent and looked groggy throughout the hearing.
He wore a maroon prison jumpsuit that appeared to be covering a bulletproof vest. And his hands and feet were shackled.
